Mount Airy Casino is facing additional complaints from former employees in a lawsuit regarding the the casino’s alleged failure to pay workers properly under federal and state wage laws. The list of plaintiffs has grown to include 75 people.
The 75th person was added to the lawsuit against Mount Airy Casino on April 9.
Suit started back in February
A series of plaintiffs came forward back in February to recoup up to $5 million in wages that weren’t paid over a three-year period. The lawsuit is claiming Mount Airy committed the following violations:
- Improperly “rounding” employees’ clock-in and clock-out times
- Failing to inform tipped employees of the required tip credit provisions before paying less than the federal minimum wage
- Creating a mandatory tip pooling policy by which it requires its table games dealers to pool their tips and then, in violation of federal law, distributing those tips to the table games dealers who earned them as well as to pay the PTO of certain non-tipped manager and supervisor employees
- Miscalculating their employees’ regular rate of pay for overtime purposes
The case is currently pending in the U.S. District Court, Middle District of Pennsylvania.
Mount Airy isn’t the only Pennsylvania casino in the midst of a legal dispute. Rivers Casino Philadelphia is also facing a lawsuit, which involves a data breach that impacted around 100 people during the holidays last year.
