Mount Airy Casino has agreed to $2.3 million to settle a lawsuit against more than 100 former employees.
The workers alleged that Mount Airy Casino failed to pay workers properly under federal and state wage laws.
The original lawsuit was filed back in February to recoup up to $5 million in unpaid wages, which then climbed to more than 100 plaintiffs.
A win for the former employees
According to WVIA PBS, the plaintiffs are entitled to at least nearly $1.5 million, with the rest covering legal fees. Each employee is subject to receive an average of more than $2,000.
It has taken almost a year to settle the case, which alleged Mount Airy of the following violations:
- Improperly “rounding” employees’ clock-in and clock-out times
- Failing to inform tipped employees of the required tip credit provisions before paying less than the federal minimum wage
- Creating a mandatory tip pooling policy by which it requires its table games dealers to pool their tips and then, in violation of federal law, distributing those tips to the table games dealers who earned them as well as to pay the PTO of certain non-tipped manager and supervisor employees
- Miscalculating their employees’ regular rate of pay for overtime purposes
There is a final hearing in February to formally approve the settlement.
