Mount Airy Casino is facing a lawsuit asking for up to $5 million in damages for the casino’s alleged failure to pay employees properly under federal and state wage laws. The former casino workers filed the complaint last week.
The employees are looking to collect wages from Mount Airy Casino over a three-year period. The lawsuit claims that the property committed the following violations:
- Improperly “rounding” employees’ clock-in and clock-out times
- Failing to inform tipped employees of the required tip credit provisions before paying less than the federal minimum wage
- Creating a mandatory tip pooling policy by which it requires its table games dealers to pool their tips and then, in violation of federal law, distributing those tips to the table games dealers who earned them as well as to pay the PTO of certain non-tipped manager and supervisor employees
- Miscalculating their employees’ regular rate of pay for overtime purposes
The case is currently pending in the U.S. District Court, Middle District of Pennsylvania.
Other Pennsylvania casinos facing lawsuits
Rivers Casino Philadelphia is also facing a class action lawsuit for a data breach that happened around the holidays last year. According to one suit, there would be at least 100 impacted customers who qualify for the class action.
One the complaints, William Moore v. Rush Street Gaming et al., the plaintiff is also seeking $5 million.
Rivers Casino Philadelphia spokesperson, Jack Horner, told PlayPennsylvania that the breach occurred on Nov. 14, 2024. The casino alerted those that were affected on Dec. 30.
Because of the breach, the plaintiff disclosed that the affected parties have been exposed for potential credit fraud or identity theft. That now requires time spent on numerous activities to prevent such from happening.
